You and Solar Illuminations agree that any cause of action arising out of or related to these T.&C. or this site must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred. The section titles in these T.&C. are solely used for the convenience of the parties and have no legal or contractual significance. For the purpose of internet law jurisdiction, outside of the State of Florida, USA, Solar Illuminations does not: conduct 'paid' advertising through non-internet media; have any sales representatives or agents; specifically market any of its products to any sole country or state; utilize the services of any manufacturer or supplier; use any computer server other than the service provided by A.A.A. in Colorado. Solar Illuminations does not have any physical business address in the United Kingdom, Republic of Ireland or in the EU. The Sale of Goods Act 1979 (as amended), Consumer Protection (Distance Selling) Regulations 2000, Consumer Protection Act 1987 and any other similar UK or Eire Regulations or Acts are therefore not applicable. While Solar Illuminations supports the idea of the Waste Electrical and Electronic Equipment (W.E.E.E.) regulations, as we are based outside the E.U. it is not safely practical, or possible for any waste material and/or batteries to be returned to us. On this basis we do not need to and are unable to comply with this regulation. Instead we recommend the end-user to sensibly dispose or recycle any product or battery using an appropriate, approved, local facility within the UK or Eire. Solar Illuminations is a USA based business (operating under US law, not UK or Irish law) and has the legal right and freedom to advertise on any internet web site, anywhere in the world (where laws permit), including a '.co.uk' site and by doing so, in no way does this imply that Solar Illuminations is a UK or Eire based business or have any physical office, warehouse or facility of any kind, in the UK or Eire. |

MAKING A PURCHASE
(A) GENERAL Making a purchase could not be easier. Just browse our Catalogue, and click on any PRODUCTS that you wish to buy and put them into the Shopping Basket. After you have finished your selection, click on 'ORDER' or 'CHECKOUT NOW' and you will be asked for a few necessary details to complete the order. Please be sure to read the PRODUCT descriptions carefully as we may place a stock notice that informs customers of limited stock or out-of-stock information. We accept most major credit cards and debits cards. We also accept Paypal. All transactions are processed via Paypal although you do not need to have a Paypal account. If you are shopping from outside the United Kingdom or Republic of Ireland you will need to visit www.solarilluminations.com to make your purchase. Larger orders may be paid by telegraphic wire transfer at your bank. Please call or email for more information on this procedure. (B) ORDERING ON-LINE We strive to make it as easy as possible for you to order online. When shopping, simply add items to your Shopping Basket from any product page, select appropriate quantities and then check-out. During the shopping process you may press the CHECKOUT button at the top of the page to view the items in the shopping basket and make any adjustments right up until the checkout pages. The following provides detailed instructions on how to order on-line. To begin your shopping experience, click 'PRODUCTS' in the navigation bar at the top of the screen or the PRODUCT categories on the home page. From this main PRODUCT directory, you can browse through any category you choose by clicking on the category name. To learn about a specific PRODUCT in detail, simply click on the PRODUCT. You can also search for a particular PRODUCT by name or category using our search function. If you need more information or technical details about any of our PRODUCTS simply click on the green 'MORE INFO' buttons to get a pop-up window which often shows additional pictures. The PRODUCT description page contains all the information you need to order an item. To add a PRODUCT to your order, select the 'ADD TO BASKET' button . The selected item will appear with the option to select the quantity, confirm, cancel or checkout now. If you wish to continue shopping then select the appropriate quantity then click 'CONFIRM' and you will automatically be taken back to the original PRODUCT catalogue page. If you wish to cancel your selection then click 'CANCEL' and you will automatically be taken back to the original PRODUCT catalogue page. At any point thereafter, you may click on 'CHECKOUT' at the top of the page to view the shopping cart and make any adjustments. However, if you have completed your shopping then click 'CHECKOUT NOW' and a summary page will then show all the PRODUCTS you intend to purchase and the prices. You are then automatically taken to the checkout page which will show all your selected PRODUCTS, the prices and the sub-total. You will need to select the postage service you require and you may see one or more options of postal services available. Our terms and conditions are also shown lower on this page. Once complete, click 'NEXT' and you will be required to enter the credit card holder's name and address which will act as the delivery address too. There are a few selections to make including the postage service required before clicking 'NEXT'. Finally, you have a choice of payment methods. You can pay by Visa, Mastercard or Delta card and enter your card details at our web site on a special secure screen. If you wish to pay by any other method including PayPal then you will need to make your selection and click the 'NEXT' button. If you have requested to pay by PayPal then the next screen will prompt you to the PayPal site, which will appear. If you already have a Paypal account you can choose to log in or just select to pay by credit or debit card. If you do not have a Paypal account then you can still select to pay by credit or debit card. The page will then show your details pre-inserted. Simply add your credit card number and expiry date and click 'SUBMIT'. You will get confirmation of the authorized transaction and the option of printing a receipt. Once complete you are automatically returned to our web site. Usually you will receive an email confirmation from us about your order. At all times, please make sure all the information you are entering is correct and without typing errors/spelling mistakes. (C) BANK TRANSFER PAYMENT There is an option to make a payment using the BACS or CHAPS bank transfer service (direct bank payment from your account to our account). If your order is of a high value or this payment method is preferred, then proceed by placing your order and selecting 'Bank Transfer' as the payment option. Complete the order and once the order has been received by us, we will forward all our necessary bank details to enable you to administer this payment. Once payment has been initiated, please allow appropriate time for our bank to receive your payment (typically 1-5 working days). Order processing can only commence once payment in full has been received and confirmed with our bank. An alternative to payment by credit or debit card or bank transfer, is to be invoiced. However this is a pre-approved option available only at the discretion of Solar Illuminations. It is only granted to well known businesses, large companies, schools, colleges, local authorities and such like. Payment is required strictly within 14 or 30 days from date of invoice, as indicated on the invoice. (D) CHEQUE PAYMENT We can accept payment by cheque but we only accept cheques from companies and businesses, at our discretion. We do not accept personal cheques. All orders that are paid for by cheque will attract additional processing time (due to postage and cheque clearance time) and this will delay receipt of your order. If you need your order quickly then we would suggest using an alternative payment method. (E) ORDERING OFF-LINE The price for a PRODUCT may differ if ordered off-line including telephone orders because all on-line (internet) orders get discounted pricing (as advertised). This is because ordering on-line via our web site is economical due to being fully automated. Off-line ordering requires additional administration in the preparation of an invoice and the manual processing of the payment. The off-line price is displayed at the web site within the PRODUCT description. Ordering on-line however, allows the benefit of receiving the discounted internet prices. When placing a telephone order and paying for a PRODUCT by credit card we may require your signature. This request is usually performed by faxing a copy of your order which will needed to be agreed and signed for, then faxed back to us. |

POSTAGE
Postage costs are based on weight of the order, the delivery address and postal service selected at time of checkout. We usually post out orders via UPS, Royal Mail, USPS or ParcelForce or any combination of these. Orders sent to Ireland may be delivered by ANPost, UPS or an alternative courier. We process most orders within 5 working days but most are processed in just 1-2 days. Your order should arrive within 2-14 working days once it has been processed and dispatched, provided it is a product that is in stock. We may offer more than one delivery service option during check-out and therefore they may be the choice of 'Standard', 'Priority' or 'Express' parcel post services. For urgent orders we recommend UPS or USPS 'Express' service. We reserve the right to select an alternative postal service should the parcel not meet the criteria for the service selected. Your order will be dispatched from our British owned warehouse in Florida, USA, as an export shipment, depending upon product availability. We will not be held responsible in any way for any unforeseen delays in the postage process such as adverse weather, postal strike, act of God, customs delay etc. For more information, see our 'Postage / Delivery Information' section. Delivery to BFPO, remote and offshore locations may attract additional costs. We do not delivery to P.O. boxes. Where postage costs allow, insurance is purchased to cover against loss or damage. In the unlikely event of a postal damage claim or a shortage, this must be reported to us with 24 hours from time of delivery. After this time, we are unable to process any claims for damage caused in transit or product shortages. Once we have proof of delivery, from the courier, to the correct address (as supplied by the customer) the parcel(s) is deemed as being sucessfully delivered and a 'non-delivery' claim will be rejected. Our usual 'Working Days' are Monday to Thursday and exclude all UK & US public holidays. Throughout the months of November and December we are exceptionally busy and any order required in time for Christmas should be made well in advance as we are not responsible for any delays during the busy festive postal season. We reserve the right to apply a 10% cancellation fee to any order that is cancelled prior to dispatch. Cancellation of an order after dispatch is not permitted. DELIVERY
We usually process most orders within 5 working days. Many orders are however, processed in 1-2 working days. Your order should arrive within 2-10 working days after processing and dispatch, provided it is an item that is in stock. Many orders arrive within just 2-7 working days once they have been dispatched, depending upon the postal service selected during check-out. Your order, depending upon product availability, will be sent out from our British owned warehouses located at our Head Office in Florida, USA, as an export shipment. We will not be held responsible in any way for any unforeseen delays in the delivery process such as adverse weather, seasonal demand, postal strikes or customs delays. For more information, see our 'Postage' section. In the unlikely event of a postal damage claim or a shortage, this must be reported to us with 24 hours from time of delivery. After this time, we are unable to process any claims for damage caused in transit or product shortages. If you have received a PRODUCT that has arrived damaged in transit then we must be notified within 24 hour from time of delivery. We may require photographic proof to enable us to file a shipping damage claim with the delivery company. Usually once we have all necessary information we can start to process the claim and send out a replacement part (in place of the damaged part) or a complete new PRODUCT, at our discretion, depending upon the nature of the problem. Once we have proof of delivery, from the courier, to the correct address (as supplied by the customer) the parcel(s) is deemed as being successfully delivered and a 'non-delivery' claim will be rejected. Delivery to BFPO, remote and offshore locations may take longer. We do not deliver to P.O. boxes. If an order is attempted to be delivered but refused by the customer for any reason, or unable to be delivered to the customer for any reason, the customer remains responsible for that order and if it is returned to sender, then all costs associated with the return will be at the customer's expense. In these circumstances a minimum 50% restocking fee will apply and the original postage costs are not refundable. Our usual 'Working Days' are Monday to Friday and exclude all UK & US public holidays. Throughout the months of November and December we are exceptionally busy and any order required in time for Christmas should be made well in advance as severe postal delays during the month of December may result in your order being delayed in transit which is beyond our control. |

BACK ORDERS
It is unusual if we do not have the product you require in stock. We hold large volumes of products at our warehouses, but sometimes we do sell out of some of the most popular lines. We usually insert an 'Out-of-Stock' notice within the product description at the web site or we insert a notice to advise of a delay. We reserve the right to apply a 10% cancellation fee to any order that is cancelled prior to dispatch. Cancellation of an order after dispatch is not permitted. We will not be responsible for inbound or outbound postage costs, upon cancellation, after an order has been dispatched. |

TAX/VAT/DUTY CHARGES
All purchases that are dispatched from our British owned warehouse in Florida, USA and may be subject to VAT and/or duties at the current rates. Such costs are excluded from our prices shown and may be payable at time of import by the customer. Currently the value of duty payable can be between 5 & 9%. VAT is currently 20% for the UK. However, the majority of our customers find that these charges are not often applied especially when the product value is below the thresholds where such charges would apply. A nominal courier/delivery company administration fee may also apply where duties/taxes are applicable. It shall therefore be deemed that all product prices exclude VAT. |

CREDIT CARD SECURITY
Solar Illuminations allows credit card payments to be made directly at our web site or via PayPal. Once you have made your selections at our web site and have entered your name and address details you will be sent to a special 'secure' payment page where you can pay by Visa, Mastercard or Delta card, or alternatively select to pay by PayPal where you can go to PayPal's secure site to make your payment. You will see a small gold padlock in the lower right corner of your browser to confirm that you are in a secure area. The payments page at our web site and that of PayPal is secure. Here, credit card information uses Secure Socket Layer (SSL) encryption. They encrypt your personal information, such as your credit card number, when transmitting over the Internet using SSL. SSL renders information unreadable should anyone try to intercept it. We use the payment gateway services of PayPal to deal with the payment processing in the most secure manner. We are confident that the service they provide ensures the ultimate security. This is a highly reputable and established provider of services and when you are transfered to their web site for entering your credit card details you can be assured that the highest levels of security are in place. You do not need to have a PayPal account in order to use the PayPal service as you are provided with the option of paying using your credit or debit card. See our Security and Privacy Policies for more information. As your credit card details are never supplied to us by PayPal. Solar Illuminations does not share, sell or trade e-mail address information with other companies. Our policy is to protect this information and use it for communication purposes only. WARRANTIES / GUARANTEES
(A) Most of our PRODUCTS purchased on, or after, May 20th 2011 carry a minimum 12 month limited warranty (from date of purchase) excluding all halogen light bulbs and all batteries. PRODUCTS purchased on, or prior to, May 19th 2011 carry a 90 day limited warranty excluding all halogen light bulbs and all batteries. Should a genuine fault develop within the warranty period, the PRODUCT will be repaired or replaced at our discretion (after inspection and testing) and in accordance with our Terms, Conditions and Policies. Our limited warranty does not cover weathering, corrosion, liquid residue or surface scratches as this is considered normal wear & tear. The warranty does not cover for damage caused by wind, lightning or any other weather related conditions or Act of God. No warranty is provided for any light bulbs or any batteries. For PRODUCTS that use multiple LED's or SMD's we do not define the PRODUCT as being defective unless more than 5% of the LED's or SMD's fail to illuminate. The limited warranty is null & void if a PRODUCT has been altered or damaged due to normal wear & tear, abuse, improper maintenance, liquid ingression, improper use, disassembly of parts and/or attempted repair, modification or alteration. (B) Solar Illuminations is not responsible for the postage and insurance costs associated with the return of any PRODUCT (regardless of reason). Such costs will be the responsibility of the customer. If a PRODUCT is returned (reported as faulty) and subsequently (after inspection and testing) have no fault found, the postage costs for the return of the PRODUCT back to the customer will be the responsibility of the customer and in addition a £40.00 inspection, processing & handling fee will apply. (C) Solar Illuminations may, at its sole discretion, offer to dispatch to the customer, only the individual and necessary parts required to remedy a problem or fix any fault. The parts will be supplied, via regular mail, to the customer, to attach or install at the customer's own risk. This would usually apply to minor problems or faults that can be quickly and easily resolved in this manner, saving the customer the time and the expense of returning a product for repair. (D) We carefully select products of the highest quality so problems are rare. We try to test and inspect many of our PRODUCTS, before there are dispatched, so this process virtually eliminates those annoying 'dead-on-arrival' situations. We recommend that a PRODUCT is not 'used' or 'installed' if there are any doubts as to it not meeting your requirements. PRODUCTS that have been 'used' or 'installed' are not fit for resale and therefore not returnable for refund. See our Returns Policy and returns procedures for more information. (E) Solar Illuminations will not be responsible for any misuse, modification, neglect or failure to install and/or use a PRODUCT in such a way that it is not recommended and/or differs from the manufacturers instructions and/or user manual resulting in poor performance or ultimate failure of the PRODUCT. We do not warranty the suitability of any PRODUCT for any particular purpose or application. Therefore it is the responsibility of the customer to the specifications and suitability prior to placing an order. (F) All solar lights operate using battery power. Rechargeable batteries, especially the Ni-Cad types that are found in most solar lights, are prone to their terminals collecting deposits and possibly corrosion. The batteries must be periodically inspected and maintained. Clean the ends of the batteries and the battery compartment terminals to remove any deposits or corrosion. These deposits can stop a battery from being recharged and therefore stop a solar light from illuminating. These problems are not related to and have nothing to do with a battery actually leaking. (G) During rainy, cloudy and winter months the rechargeable batteries may not get fully charged and the light may appear dimmer and/or may not illuminate for very long. The same may apply if the PRODUCT is placed in a shady or part shaded location. This is normal and does not constitute a fault in the PRODUCT. Positioning the PRODUCT close to other nearby lighting sources (e.g. street lights, porch lights, outdoor & house lighting etc) may affect the photocell (light sensor) and prevent the light from operating properly or from illuminating at all. This also is normal and does not constitute a fault in the PRODUCT. Simply relocate the PRODUCT to another location or mask some of the photocell. (H) Solar Illuminations does not offer repair services for any product outside of warranty. However, we do offer a limited range of spare parts, for some of our most common products, should a customer wish to purchase a spare part for a PRODUCT that is out of warranty. Taking advantage of Secure Sockets Layer (SSL) technology, Solar Illuminations ensures the security of your online transaction. The industry standard for encryption, SSL technology creates a secure transaction environment for commerce on the Internet. SSL technology encrypts files allowing only Solar Illuminations to decode your information. Both Netscape and Internet Explorer indicate when you are connected to a secure server. You will see that your transaction is secure when your are transferred to our payment screen or our payment gateway provider called PayPal. RETURNS POLICY
Within 14 days (from date of invoice), a PRODUCT may be returned for exchange (or for refund where permitted) subject to the PRODUCT being in its new and unused condition. Exceptions to this are PRODUCTS defined as a 'special order'. It must be 100% complete with all parts, instructions and undamaged packaging, exactly as originally supplied, and so that it is fit for resale. Sorry but we are unable to refund or exchange 'used' or 'installed' PRODUCTS. All returns must be pre-authorised (please call us for an RMA number and return instructions). The return must be received within 14 days of being authorised and we recommend that appropriate shipping insurance is obtained because we are not responsible for any loss or damage of a PRODUCT being returned. Except for warranty claims, failure to request a return after 14 days (from date of invoice) will be deemed to be permanent acceptance of the PRODUCT. Do not attempt to return a PRODUCT without a valid RMA number clearly displayed on the shipping carton as it will not be accepted and will result in being returned to the sender at the sender's expense. All returns must be shipped in a separate, appropriate shipping carton with suitable packing materials to avoid damage. Shipping costs are not refundable and Solar Illuminations does not arrange or pay for shipping of any PRODUCT being returned unless we have shipped an incorrect PRODUCT, in error, then we will arrange for pre-paid return shipping. All returns must be sent to our USA Headquarters. Solar Illuminations is a US Corporation and has no physical address in the UK. Do not send any parcels to the UK office which is a call centre, accepts letters and documents only and is not our physical address. For warranty repairs. a technician fee may apply for inspection, handling, return shipping of a PRODUCT that is returned reported as 'faulty' but has no fault found. Shipping costs to/from an international address are the responsibility of the customer regardless of the reason for the return. If a PRODUCT is found to be faulty within the warranty period, it will be repaired or replaced, at our discretion. New and unused returns that are approved to be refunded are subject to a 25% restocking fee. The restocking fee applies to shipments that have been refused, shipments that have not be delivered and orders that have been cancelled after being shipped. Refunds are usually processed within 14 working days from the date returned. Solar Illuminations reserves the right to refuse any non-compliant return and ship the PRODUCT back to the customer (at the customer's expense) thereby refusing the repair, replacement, exchange or refund, where the customer has failed to comply with our Terms, Conditions and Policies. We are not responsible in any way, financially or otherwise, for the installation and/or re-installation of any PRODUCT or any other consequential loss. A limited amount of PRODUCTS offered are defined as a 'Special Order' and are non-returnable and non-refundable. This is mentioned in the product description or technical specifications (access by clicking the green MORE INFO button for any PRODUCT). These PRODUCTS are 'all sales final' and are not eligible to be returned for refund and can only be returned if the PRODUCT is defective which (if under warranty), upon inspection & testing is found to be defective, the PRODUCT will be repaired or replaced (at our discretion) with an identical PRODUCT. |

Do not 'use' or 'install' a product unless you intend to keep it. Once a product is used or installed it cannot be returned for refund or exchange. Thoroughly check your order, immediately, upon receipt. No exceptions. Postal damage claims, shortages or missing parts must be reported to us, by telephone, within 24hrs of receipt. All original packaging & the shipping carton must be retained as failure to do so will result in your claim being denied. No exceptions. All returns require pre-authorization with an RMA number. Return requests (requiring refund or exchange) must be telephoned in, within 14 days of receipt, and only apply to brand new, un-used, un-installed products, that are 100% complete with their original, un-damaged, un-marked factory carton and packaging. No exceptions. Do not return a product without a valid RMA number clearly shown on the outer shipping carton otherwise it will be refused and returned at your expense. Mailed documents are accepted at our London adddress. However parcels and returned products are not accepted at the London address. They must be sent to our USA Headquarters only. All returns for refund are subject to a 25% restocking fee. Return requests under warranty (for repair or replacement) must be called in and reported within the warranty period.
